Mumbai: Tata Steel on Friday disclosed to stock exchanges that legal proceedings have been initiated against its Netherlands-based subsidiaries by a Dutch NGO, which has raised concerns over environmental pollution and public health issues linked to the company’s operations.
In a regulatory filing, the steel major confirmed that Stichting Frisse Wind.nu (SFW) issued a writ of summons on December 19 to Tata Steel Nederland B.V. and Tata Steel IJmuiden B.V., collectively referred to as Tata Steel Nederland (TSN).
The legal action has been filed before the District Court of North Holland in Haarlem and has been brought under the Dutch Act on Collective Settlement of Mass Claims (WAMCA), a law that allows collective claims on behalf of affected groups.
Tata Steel Netherlands lawsuit Filed Under Dutch Mass Claims Law
According to the filing, SFW claims to represent residents living in and around Velsen-Noord, an area close to Tata Steel’s industrial facilities in the Netherlands. The organisation alleges that emissions released from the company’s plants include hazardous and harmful substances that have adversely impacted both the local environment and the health of nearby communities.
The lawsuit further alleges that these emissions have contributed to long-term damage and have resulted in losses suffered by residents living in the vicinity of Tata Steel’s operations.
Health and Environmental Allegations Raised by Local Residents
The nonprofit organisation has asserted that the emissions from Tata Steel’s facilities have negatively affected the quality of life of surrounding residents, citing concerns related to environmental degradation and well-being.
SFW maintains that the alleged pollution has caused measurable harm, prompting it to seek legal recourse on behalf of the impacted population under collective settlement provisions.
Tata Steel Netherlands lawsuit: Company Prepared to Contest Claims
Tata Steel stated that its Netherlands unit is fully prepared to defend itself against the allegations raised in the lawsuit. The company emphasized that, based on its initial assessment, SFW may face considerable hurdles regarding both the admissibility of the case and the validity of the claims being made.
Although TSN has not yet received the complete set of documents and evidence that SFW plans to rely on, the company noted that it has already identified substantial legal grounds to contest the case.
Company Signals Strong Legal Defence Strategy
Reiterating its stance, Tata Steel said it intends to challenge the allegations vigorously and will take all necessary legal measures to safeguard its interests.
“TSN is fully prepared to defend against the claim. In our assessment, SFW faces significant challenges with respect to both admissibility and the merits of the case,” the company said in its exchange filing.
