India Rejects International Court Jurisdiction on Indus Waters Treaty Dispute

New Delhi: India has rejected the jurisdiction of the Permanent Court of Arbitration (PCA) over the Indus Waters Treaty dispute, maintaining that it has never recognized the court’s authority in such matters.

This comes after Pakistan welcomed a recent PCA ruling interpreting design criteria for new run-of-river hydropower projects on the Western Rivers — Chenab, Jhelum, and Indus — to be built by India. The court reportedly ruled that India must “let flow” these waters for Pakistan’s unrestricted use.

Indus Waters Treaty Dispute Pakistan Says Ruling Supports Its Stand

Pakistan’s foreign office claimed the judgment validates its stance, stating that hydroelectric projects must follow treaty requirements strictly, not India’s version of “best practices.” The IWT, brokered in 1960, governs water sharing between the two nations.

India’s Position on Neutral Expert Mechanism

India insists disputes should be resolved through the neutral expert mechanism outlined in the treaty, not via international arbitration. In past cases — including the Kishanganga and Ratle projects in Jammu & Kashmir — India opposed the World Bank’s 2022 decision to activate both a neutral expert and the Court of Arbitration simultaneously, citing legal and procedural conflicts.

No Treaty Resumption Without Action on Terrorism

While Pakistan reiterated its commitment to implementing the treaty and called for resumption of its functioning, India has made it clear the IWT will remain in abeyance until Pakistan takes concrete action against cross-border terrorism.
