Indus Waters Treaty: India Rejects Court of Arbitration Ruling on Kishenganga and Ratle Projects

Published on

India has strongly rejected a recent ruling by the so-called Court of Arbitration concerning the Kishenganga and Ratle hydroelectric projects located in the Union Territory of Jammu and Kashmir. The Ministry of External Affairs (MEA) declared the ruling null and void, terming the court’s constitution a blatant violation of the Indus Waters Treaty (IWT) of 1960.

India Declares Arbitration Court Invalid

In a statement issued on Friday, the MEA categorically stated that India has never recognized the legality or jurisdiction of the Court of Arbitration. It emphasized that the constitution of this forum is a “serious breach” of the IWT and that any decision or proceedings under it hold no legal ground.

India Suspends Indus Waters Treaty

The MEA also confirmed that the Indus Waters Treaty has been placed in abeyance following the Pahalgam terrorist attack, which was attributed to Pakistan-backed groups. The Ministry asserted that due to Islamabad’s continued support for cross-border terrorism, India is no longer obligated to adhere to the terms of the Treaty.

“No Court of Arbitration has the authority to question India’s sovereign decisions,” the statement added.

The Ministry strongly criticized Pakistan for orchestrating what it called a “fabricated arbitration mechanism” in a bid to deflect global scrutiny over its role in sponsoring terrorism. “This latest charade at Pakistan’s behest is yet another desperate attempt to escape accountability for its actions as the global epicenter of terrorism,” the MEA said.
