  • Orissa High Court imposes ₹1 lakh penalty on senior officer for delay
  • Court slams “scant respect” towards judicial orders
  • Daily fines warned if payment is not made within four weeks

Cuttack: The Orissa High Court penalty delay order has sent a sharp warning to government officials after a senior officer was fined ₹1 lakh for failing to comply with a court directive on time. The ruling highlights growing judicial intolerance toward bureaucratic delays that undermine court authority and citizen rights.

A Division Bench of Justices Krishna Shripad Dixit and Chittaranjan Dash criticized the conduct of the officer, stating that such delay reflects disregard for constitutional institutions.

Court Pulls Up Officer Over Contempt and Delay

The case involved Manoj Kumar Pattnaik, serving as Under Secretary-cum-Deputy Secretary in the Food Supplies and Consumer Welfare Department of Odisha. The court observed that he failed to act within the timeline set by an earlier order.

Back on December 18, 2024, the High Court had instructed the department to take a decision and inform petitioner Debasish Nayak within two weeks. However, the decision came only on February 19, 2026, and was communicated days later.

The Bench described this delay as serious misconduct, calling it “contumacious” and unacceptable in a system governed by the rule of law.

Orissa High Court Penalty Delay Order Sends Strong Message

The court made it clear that such behavior cannot be ignored. While it chose to drop formal contempt proceedings, it imposed a financial penalty directly on the officer, to be paid from his personal funds.

Judges emphasized that government officials must treat court orders with urgency and seriousness. Failure to do so not only harms individuals seeking justice but also weakens institutional accountability.

Strict Penalty Clause if Officer Fails to Pay

The ruling includes a strict enforcement clause to ensure compliance. If the ₹1 lakh penalty is not paid within four weeks, additional fines will apply.

Escalating Daily Fine Structure Explained

  • ₹500 per day for delay during the first month
  • ₹1,000 per day for continued delay beyond that period

This escalating penalty structure signals the court’s intent to enforce accountability beyond symbolic action.

The judgment reinforces a broader principle. Delays in governance are no longer seen as routine inefficiency but as a violation of judicial authority that can carry personal consequences for officials.
