MeitY Notifies IT Rules 2025 Amendment to Strengthen Accountability

The Ministry of Electronics and Information Technology (MeitY) has officially notified the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2025, introducing crucial updates to the IT Rules 2021.

These amendments aim to fortify the framework of due diligence obligations imposed on intermediaries under the Information Technology Act, 2000, enhancing transparency, proportionality, and accountability in content moderation processes. The new IT Rules 2025 Amendment will come into force from November 15, 2025, according to an official statement released today.

IT Rules 2025 Amendment Introduces New Safeguards for Content Removal

The latest amendments modify Rule 3(1)(d) of the IT Rules 2021, adding specific safeguards to ensure that the removal of unlawful content is conducted fairly and transparently. Intermediaries such as social media platforms and digital media services are now required to follow clearer, more structured procedures when taking down unlawful information. The updated framework emphasizes the importance of proportionate action and accountability in every decision related to content removal.

According to MeitY, these changes stem from a comprehensive review process that identified the need for enhanced checks and balances, particularly in the handling of government directions and legal orders related to content moderation.

Focus on Senior-Level Accountability and Periodic Review

Under the revised IT Rules 2025 Amendment, intermediaries must now ensure senior management oversight in decisions regarding unlawful content. This measure is intended to enhance institutional responsibility within organizations managing online platforms. Additionally, MeitY has introduced provisions for periodic review of government directions at a higher administrative level to ensure decisions remain balanced, justified, and aligned with constitutional safeguards.

The amendments also underscore the necessity for precise identification of unlawful content categories, reducing ambiguity and the risk of over-compliance by intermediaries.

Background: Evolution of India’s IT Rules

The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, were first notified on February 25, 2021, and subsequently amended on October 28, 2022, and April 6, 2023. These rules were designed to establish clear due diligence obligations for intermediaries with the goal of improving online safety, security, and accountability.

Under the original Rule 3(1)(d), intermediaries were mandated to remove unlawful content upon receiving actual knowledge through either a court order or a notification from the Appropriate Government. The 2025 amendments build upon this framework to make the process more transparent and accountable to both users and the legal system.

Strengthening India’s Digital Governance Framework

MeitY’s review emphasized that the dynamic digital landscape demands stronger oversight mechanisms and clearer standards of accountability. The IT Rules 2025 Amendment reinforces India’s commitment to responsible digital governance while safeguarding the rights of users and ensuring that intermediaries operate with greater transparency.

The move is expected to further solidify India’s position as a leading digital economy by striking a balance between freedom of expression and protection against unlawful online activity.
