New Delhi/Kolkata: The Supreme Court on Monday directed the Election Commission of India (ECI) to decide the dispute between two rival factions of the Trinamool Congress over the party name and its “Flowers and Grass” election symbol within three months after the parties complete their pleadings. The rival sides have been given four weeks to submit their documents and responses.
The order was passed by a three-judge bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V Mohana while hearing a petition filed by former West Bengal Chief Minister Mamata Banerjee challenging the ECI’s interim decision concerning the party’s name and symbol.
Supreme Court Sets Timeline for TMC Name and Symbol Case
The court directed both sides to complete their pleadings before the Election Commission within four weeks. After that process is completed, the ECI will have three months to decide the dispute.
During the hearing, senior advocate Dama Seshadri Naidu, appearing for the poll panel, sought more time for the ECI to adjudicate the matter. The court, however, fixed the three-month period after completion of the pleadings.
The proceedings will involve additional documents, affidavits and counter-affidavits from the contesting sides before the Commission considers the substantive dispute.
Dispute Over TMC’s Traditional Election Symbol
The dispute concerns the right to use the All India Trinamool Congress name and the reserved “Flowers and Grass” symbol.
The ECI had earlier passed an interim order preventing both rival groups from using the original party identity and symbol while the substantive dispute is considered under the Election Symbols (Reservation and Allotment) Order, 1968.
The poll panel subsequently allotted separate names and symbols to the two factions for the upcoming by-elections.
Mamata Banerjee’s Plea Before Supreme Court
The Supreme Court’s latest order came during the hearing of Mamata Banerjee’s challenge to the ECI’s interim decision.
The court had earlier asked the Election Commission to provide a reasonable timeframe for resolving the dispute and stressed that the proceedings should not be unnecessarily prolonged.
With the latest directions, the immediate schedule is clear: the rival factions must complete their pleadings within four weeks, followed by a three-month period for the Election Commission to decide the name and symbol dispute.
The ECI’s decision will determine the outcome of the substantive dispute over the party’s name and reserved election symbol.
