Justice Surya Kant Recommended as 53rd Chief Justice of India by CJI B.R. Gavai

Justice Surya Kant, currently the second senior-most judge of the Supreme Court, has been formally recommended by outgoing Chief Justice of India (CJI) B.R. Gavai as his successor. The official communication has been sent to the Centre, clearing the path for Justice Kant’s appointment as the 53rd Chief Justice of India. His tenure will begin on November 24, 2025, a day after CJI Gavai’s retirement.

Appointment Process and Constitutional Procedure

According to the Memorandum of Procedure that governs judicial appointments, the senior-most Supreme Court judge considered suitable is elevated as the Chief Justice of India. The Union Law Minister typically seeks the recommendation of the incumbent CJI about a month before retirement. Justice Surya Kant’s nomination follows this long-standing convention, ensuring a seamless transition in the top judicial post.

Judicial Journey and Professional Background

Born on February 10, 1962, in Hisar, Haryana, Justice Surya Kant began his career as an advocate at the Punjab and Haryana High Court before being elevated as a judge in 2001. He went on to serve as Chief Justice of the Himachal Pradesh High Court before his appointment to the Supreme Court on May 24, 2019. Once he assumes office, Justice Kant will serve as Chief Justice of India for nearly 15 months, until his retirement on February 9, 2027.
