Digital Personal Data Protection Bill Passed in Both Rajya Sabha and Lok Sabha

New Delhi: The Digital Personal Data Protection Bill passed by the Rajya Sabha on August 9 by voice vote, advancing India’s first data protection law. After receiving President Draupadi Murmu’s approval, the bill will become a law. The Lok Sabha had earlier on August 7 passed the bill.

Ashwini Vaishnaw, the minister of electronics and information technology, presented the bill for approval in the Parliament’s upper house.

Since the Supreme Court ruled in 2016 that the Right to Privacy is a Fundamental Right, subject to reasonable limitations, several segments of society have requested the law.

A joint parliamentary committee was assigned to review a Personal Data Protection (PDP) Bill that was introduced in 2018 and presented in 2019. The panel analyzed the law for two years before presenting its findings and a PDP law that had been changed in December 2021.

However, the PDP Bill was dropped by the government in 2022, citing compliance-related issues, and was replaced a short time later by the Digital Personal Data Protection Bill. The measure was cleared for introduction into the current monsoon session by the cabinet’s approval in July.
