MUMBAI: The Bombay High Court fast-track courts initiative marks a significant step towards faster prosecution of paper leak and examination malpractice cases. Acting on a request from the Union Ministry of Law and Justice, the High Court has designated special courts in Aurangabad and Nagpur to exclusively handle offences related to unfair practices in public examinations.
The move is expected to accelerate the disposal of cases involving examination fraud while reinforcing confidence in the country’s competitive examination system through quicker judicial proceedings.
Bombay High Court Fast-Track Courts to Hear Examination Fraud Cases
According to the High Court’s order, the Court of Shri S.V. Pawar, 10th Joint Civil Judge (Senior Division) and Additional Chief Judicial Magistrate, has been designated as the Special Fast-Track Court for cases arising within the Aurangabad judicial district.
Similarly, the Court of Shri Gulshan R. Kolte, 7th Joint Civil Judge (Senior Division) and Additional Chief Judicial Magistrate, will function as the designated Fast-Track Court for cases originating in the Nagpur judicial district.
These courts will exclusively conduct trials under the Public Examinations (Prevention of Unfair Means) Act, 2024, along with applicable provisions of the Bharatiya Nyaya Sanhita, 2023 and the Maharashtra Prevention of Malpractices at University, Board and Other Specified Examinations Act, 1982.
High Court Orders Transfer of Pending Cases
The High Court has directed the Principal District and Sessions Judges of Aurangabad and Nagpur to formally notify the designated courts and immediately transfer all pending cases that fall within their jurisdiction.
The district judiciary has also been instructed to submit compliance reports after completing the transfer process, ensuring that examination-related cases are taken up without unnecessary delay.
Bombay High Court Fast-Track Courts Aim for Speedier Justice
The establishment of dedicated fast-track courts reflects growing efforts to strengthen legal action against paper leaks, impersonation, organised cheating and other examination-related offences. Faster trials are expected to improve accountability, deter organised malpractice and reinforce public trust in the fairness and credibility of India’s public examination system.
